1. DEFINTIONS

IN THESE GENERAL TERMS AND CONDITIONS IT MEANS:

The seller: the natural or legal person who offers products and / or services to consumers from a distance.

The consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the seller.

Reflection period: the period within which the consumer can make use of his right of withdrawal.

Return: the consumer can make use of his right of withdrawal, this is the option for the consumer to cancel the distance contract within the cooling-off period.

Day: working days, i.e. excluding Saturdays, Sundays and holidays. 

2. The seller

Registered office: HEMAR Consulting bvba, Geldmuntstraat 4, 8000 Bruges, Belgium. Registered in the Crossroads Bank for Enterprises (CBE) under number 0541.508.636. The VAT number is BE 0541 508 636. 

 

3. Scope

Each order counts as acceptance by the consumer of our general terms and conditions, which are an integral part of the agreement, to the exclusion of all other general or special conditions based on the consumer, unless expressly stipulated otherwise in writing. 


4. Prices and payment

The offer contains a complete description of the product offered. This always contains the price and any discount offered. All prices include 21% VAT and exclude shipping costs.

At "Studio Me.Mo." you have the option to pay via: Bancontact / Mister Cash, Credit card.

 

 

5. Shipment 

The orders are delivered to the delivery address as specified by the Customer during the ordering process and according to the conditions described there. Incorrect delivery addresses are the responsibility of the consumer and may lead to additional costs.

Unless otherwise specified, our prices do not include the transport and delivery of the goods to the consumer. The costs of transport and delivery are stated separately.

 

The stated delivery times are not binding, but are purely indicative. No delay in delivery can lead to cancellation of the purchase or payment of compensation in favor of the consumer.  

We have the right to make partial deliveries.

In case of non-delivery of the goods, any sums paid by the consumer will be refunded as soon as possible without interest or other compensation. 

The transfer of risk to the customer takes place at the time of delivery. Each delivery is deemed to have been completed as soon as the product is made available. 

 

6. Reflection period and return conditions

In the context of distance selling to consumers within the scope of the Law of 6 April 2010, the consumer has the right to notify the seller that he or she is renouncing the purchase, without penalty and without giving of motive within 14 (fourteen) days from the day following the delivery. 

If the consumer invokes this option, he must return the goods in their original condition, with the original labels, unused and in the original packaging at his own risk and expense to Studio Me.Mo., Geldmuntstraat 4, 8000 Bruges, Belgium.

Unstamped returns will not be accepted. 

Goods that are specifically designed for the consumer or that can spoil will not be taken back and the consumer cannot therefore invoke the right of withdrawal. 

Due to hygiene reasons, earrings cannot be returned.

The return shipment will be done by Studio Me.Mo. checked. After a successful check, the item will be settled with you. You can expect a refund to your account within 2 (two) weeks.

 

7. Warranty

Our guarantee is limited to the guarantee for hidden defects and the guarantee in case of consumer purchase, both provided for in the Civil Code.

If a product does not comply, you will find the necessary information regarding the return of purchased goods under the heading "Shipping and returns". When your return shipment is accepted and all conditions have been met, we will refund the purchase price. This can never be greater than the amount invoiced to the consumer. 

Usual or normal wear and tear, accidental or deliberate changes to the product by the consumer, the inability to present an invoice or valid proof of payment and various negligence are express but not exhaustive exceptions to the above-mentioned warranty system.    

 

8. Force majeure

We are not liable for any delay in performance or for non-performance of our commitments due to events beyond our normal control, including production interruptions, supply difficulties or shortages of raw materials, labor, energy or transportation, or delays in transportation, strikes, work stoppages or other collective labor disputes that affect either ourselves or our suppliers, even if these events are foreseeable. 

 

9. Complaints

We try to describe and clarify the offered articles as accurately as possible on the basis of photos.

If typing errors occur (material errors, mistakes), this is based on a human, involuntary error and no rights can be derived from this.

Colors in the photos may also differ slightly from the real colors. Settings and quality of your screen can influence this, as well as the incidence of light. We cannot accept exchanges based on color deviations.

We also make every effort to check our products as closely as possible for any errors or defects.

In order to be admissible, any complaint must be formulated in detail by signed letter or email within 5 (five) days after receipt of the goods.

We make every effort to prevent, remedy and resolve any complaints.

We cannot be held liable for injuries or damage resulting from the use of our products.

10. Governing Law

 

All agreements concluded with the seller are governed by Belgian law. The Belgian courts have exclusive jurisdiction.
